Qaçqın və məcburi köçkünlərlə bağlı normativ hüquqi sənədlər Normative and Legal Instruments adopted in relation to the Status of the Refugees and Internally Displaced Persons and Improvement of their Living Conditions during the Presidential Government of Mr.Ilham Aliyev, President of the Azerbaijan Republic
Normative and Legal Instruments adopted in connection with Social Protection of the Refugees and Internally Displaced Persons ( October 2003-October 2008) For improving of legal base related to social protection of the refugees and internally displaced persons the President of the country has signed 18 degrees and orders, Milli Mejlis (Parliament) has adopted 2 laws and the Cabinet of Ministers has adopted 64 resolutions and orders, and by Order No.298 of the President of the Azerbaijan Republic, dated July 1, 2004 the State Program "On improvement of living conditions of the refugees and internal displaced persons and employment promotion", and the Supplements made to that State Program by Order No.2475, dated October 31, 2007 have been approved.
By Decree of the President of the Azerbaijan Republic, dated February 1, 2005 the Regulations on the State Committee of the Azerbaijan Republic on Deals of Refugees and Internally Displaced Persons have been approved.The following privileges of the refugees and internally displaced persons have been covered by national legislation by taking into account the international practice:
The Privileges of the Refugees and Internally Displaced Persons Refugees: In accordance with Article 5 of Law of the Azerbaijan Republic "On the Citizenship of the Azerbaijan Republic", the refugees settled in the territory of the Azerbaijan Republic from January 1,1988 to January 1,1992 shall be considered the citizens of the Azerbaijan Republic, but they reserve the rights of "refugee" status and returning to their countries from the political standpoint;
they are free from notarial fee in case of selling or purchasing the apartments or houses;
Pursuant to group decision of the Ministry of Education dated 2004, the refugees from Armenia and who were born during 1988-1992 are free from the education free existing at the state higher schools and specialized secondary education;
In accordance with paragraph 3 of Order No.298 of the President of the Azerbaijan Republic, dated July 1, 2004, the management of the private enterprises, higher and specialized secondary education establishments were recommended to render assistance to the refugees and internally displaced persons in provision of employment and payment of education fee.
Internally displaced persons:- Pursuant to paragraph 2 of Order No.298 of the President of the Azerbaijan Republic «On approval of the State Program » On improvement of living conditions of the refugees and internal displaced persons and employment promotion, dated July 1,2004 eviction of the internally displaced persons in 1992-1998 from the buildings,apartments,plot of lands and other facilities not depending on their ownership and where they have settled temporary shall be suspended until their returning to their native lands, as well as resettlement to new settlements and houses for the purpose of living temporarily.
According to paragraph 3 of Order No.298 of the President of the Azerbaijan Republic, dated July 1, 2004 the management of the private enterprises,higher and specialized secondary education establishments were recommended to render assistance to the refugees and internally displaced persons in provision of employment and payment of education fee. they are free from making payment for public utilities and other services (electricity,natural gas ,drinkable water,subscription fee for telephone), the persons settled temporarily in the cities and regions which are not supplied with natural gas, will be provided 40 liter kerosene in the monthly basis during autumn and winter, Pursuant to Order of the President of the Azerbaijan Republic the internally placed persons getting payable education at higher and specialized secondary education establishments are free from making payment for education. Except for Baku, Sumgayit cities and Absheron district, 270 thousand internally displaced persons who have settled in other territories of the republic are provided with food assistance on the monthly basis. the internally displaced persons getting education at comprehensive schools are provided with free textbooks. 15 thousand internally displaced personc who were previously employed by organizations and entities financed from the state budget and lost their jobs due to the circumstances not depending on themselves and currently unemployed have been provided with average monthly wages from May ,1994.
